THIS INDENTURE, made the 9th day of January, in the year of our Lord one thousand
nine hundred and twenty-three.
BETWEEN THE CALIFORNIA-RIO GRAND LAND & STOCK CO.,
a corporation organized, acting and existing under the laws of the
State of California, and having its principal place of business in the City of Santa Cruz,
County of Santa Cruz, State of California, the party of the first part, and

ELISHA BROOKS,
W. J. SILVEY,
L. B. DeJOINKE,
ALICE HARTMAN and
NORMA PARADIS,
Trustees, of the County of Santa Cruz, State of Calif-
ornia, the parties of the second part,

WITNESSETH: That the said party of the first part, for and in consideration of the sum
of TEN DOLLARS ($10.00), lawful money of the United States, to it in hand paid by the said
parties of the second’ part, receipt whereof ls hereby acknowledged, does by these presents
grant, bargain, sell and convey unto the said parties of the second part, and to their success-
ors, in trust for the benefit of the citizens of Ben Lomond, Santa Crus County, California,
all that certain lot, piece or parcel of land situate, lying and being in the Town of
Ben Lomond, County of Santa Cruz, State of California, and bounded and particularly described
as follows, to wit:

BEGINNING at an iron pipe on the North side of Mill Street in the Town of Bon Lomond
at the South East corner of lands conveyed by Elisha and Ellen Brooks to Frederick W. Dubois
by deed dated May 6th, 1911, and recorded at page 82 in Volume 233 of Deeds, Santa Cruz County
Records; thence N. 87° 10′ E. 60.08 feet to a pipe; thence leaving the North side of Mill Street
N. 0° 55° W. 107.57 feet to a station from which an Iron pipe bears S. 0° 55° E. 0.14 feet
distant; thence S. 88° 62′ W. along the produced North line of said lot of Dubois 60 feet to
the Northeast corner of said lands of Dubois; thence along the East line of said lands of
Dubois S. 0° 55° E. 109.35 feet to the place of beginning.

RESERVING for road purposes only from the above described lot a strip of land on the
Southerly end thereof described as follows: Beginning at the Southwest corner of the above
described lot; thence N. 87° 10′ E. along Its South boundary 60.03 feet to the Southeast corner
thereof; thence N. 0° 55° W. 0.57 feet; thence S. 88° 52° W. 60 feet to the East boundary of
said lot of Dubois; thence S. 0° 55′ E. 2.36 feet to the place of beginning.

TOGETHER with all and singular the tenements, hereditaments and appurtenances there-
unto belonging, or in anywise appertaining, and the reversion and reversions, remainder and
remainders, rents, 1issues and profits thereof.

TO HAVB AND TO HOLD, all and singular the said premises, together with the appurten-
ances, unto the said parties of the second part, and to their successors in trust for the
benefit of the citizens of Ben Lomond, Santa Cruz County, California,
The above described property is conveyed to the parties of the second part to be
held in trust for citizens of Ben Lomond; California, and ie to be used for the benefit of
the community of Ben Lomond, California.
The Said Trustees above named, and their successors, receive and accept this convey-
ance with the understanding that the said above described property shall be used for the best
interests and benefit of the community of Ben Lomond, and with the further covenant upon their
part that in the matter of the use or the sale, or other disposition of said property, they
will be controlled by a majority vote of the citizens of said Ben Lomond, present and voting
at a town meeting duly called by posting notices in three prominent places in said Town,ten
days before the holding of any such meeting. At any such meeting said citizens of Ben Lomond
may, by a majority vote, name a successor to any Trustee who may have died or resigned, and
may also authorize, direct and compel the sale or other disposition of said property, or any
part thereof. By “citizens of Ben Lomond” is meant any and all persons residing or owing
property within a radius of 1-1/2 miles of the herein above described property.

IN WITNESS WHEREOF, the said party of the fi r s t part has caused these presents to be
executed by Its President and Secretary thereunto duly authorized, and Its corporate seal to
be hereto attached, the day and year first hereinabove written.

before me, H. W. H. PENNIMAl, a Notary Public In and for the said County of Santa Crus, State
of California, residing therein, duly commissioned and sworn, personally appeared, W. P.
NETHERTON AND E. M. WHINERY known to me to be the PRESIDENT AND SECRETARY, respectively of the
corporation described in and that executed the within instrument, and also known to me to be
the persons who executed it on behalf of the corporation therein named, and they aoknowledged
to me that such corporation exeouted the same.

IN WITNESS WHEREOF, I have hereunto set my hand and affixed my offioial seal at my
office in the said County of Santa Cruz, the day and year in this certificate first above
written.
